my fiance has been taking care of his son alone since he was born and hes now 3. the mother who left him and didnt want any part of the child is now trying to take him away. she is accousing him of alcohol around the house. yes he does drink but not around his son. if hes drunk or even planning on drinking he takes him to his mothers house before he does. hes a great father and now all of a sudden the mother is trying to turn and pinpoint the wrong subjects. so can child services really take his son away? what can be done because i dont know much of this subject….

Childrens services will do an investigation into it but they will need evidence in order to remove the child. They also are use to custody cases being handled like that where the noncustodial parent makes accusations so they are usually pretty good about handling it. When it comes up in court a GAL will probably be given which is a lawyer for the child and they will also talk to both the mother and father and come to the homes and give an opinion on what they feel would be best for the child but chances are if he has had him alone for 3 years now especially if there haven’t been visits with the mother then the courts will go with him keeping custody as best for the child. But no they won’t just walk in and take the boy just because the mother suddenly wants in the picture.

Not likely. They have to have a good reason to take a child away from the parent. Drinking when not with your child is not an issue. I have seen people with real drug problems who have not lost their children. The courts like to keep the status quo, so even if she fights for placement, she will probably only receive visitation to start with. The child is accustomed to being with his father. They recognize that children have an easier time remaining with the parent they are used to being with.
Of course I can’t guarantee this, especially as probably live in a different state and don’t know the details, but it is very unlikely that he would lose placement all together.

if she left her son and hasn’t wanted anything to do with him, he should file some sort of abandonment suit against her. Besides, they’d have to investigate her claims before they’d do anything.

Sounds to me like she found out what a cash cow your fiance could be if she got custody and sued for support. Now she’s trying to take the spotlight off her bad parenting and prove that he’s a bad parent. My advice get a lawyer and fight.
