Age of consent is 16. However, “a person may not be convicted of a violation of the provisions of this item if he is eighteen years of age or less when he engages in illicit but consensual sexual conduct with another person who is at least fourteen years of age.” (SECTION 16-3-655)

So, in your scenario, the boy can be prosecuted since the girl is under the age of 14. It doesn’t matter where they live. The state where the act took place has jurisdiction.

If she was 13 and you 16, then you’re screwed. You’re over the age required to get in trouble and she is under the age to get you in trouble. And the pregnancy is proof that the act occured. Fault is not an issue for statutory rape. Your mental state is irrelevant. It’s a strict liability crime, meaning the circumstances are irrelevant. The fact that you did it, is all that needs to be proved by a prosecutor. County laws are not relevant. It is the states laws that matter. by the way, nothing about the parents or grandparents matters at all. It’s totally irrelevant. All that matters is that the act was committed. And the pregnancy is proof that the sexual encounter occurred. Even if a girl lies and says she’s 18, it’s still statutory rape. Even if you see an ID that says shes 18, its statutory rape. Nothing matters except the fact that it happened, not what you thought or she thought or what the parents and grandparents did said, etc.
