What can be done when court orders no drinking alcohol but it still continues?

My boyfriend was arrested after assulting my son. The court order says no drinking but he continues anyway. He has moved out of town in order to drink without local authorities knowing. I am told nothing can be done if it doesnt happen in the town he went to court in. He is awaiting sentencing yet so he isnt on probation. Why cant they order him to submit to a U/A no matter where he is living?

UPDATE: He is not my boyfriend now, he was at the time. I am trying to see that he gets what is coming to him but since he has already plea bargained to a lesser crime, I dont know if it is possible. Catching him drinking maybe our only way for justice.
Unfortunatly it was the court that said it would be too much work to chase him down to the next town. I thought all they had to do was call him and order him to report for a u/a

Why is this chap still your boyfriend then?
How old is your son? Is he an adult? Or is he still a child?
Also, wouldn’t you want to put your son first, whether he’s still a child or an adult?

What you can do is write a letter, and send it to the judge handling his case, the judge will use the letter when sentencing him. If you don’t know who the judge is, contact the Court Administrater, and they can get the information for you. Good Luck!

Let me get this straight, you have an abusive alcoholic who was convicted of assaulting your child, who is awaiting sentencing for the crime and who is not complying with his court order to stop drinking, and you refer to him as your boyfriend? Your child needs protection from you as well as your boyfriend.

I would hope you are NOT with this man that assaulted your son. If you are you NEED HELP yourself and shouldn’t worry about what he is doing. Why would you care anyways what he is up too? Makes no sense. Get healthy lady and LET THIS LOSER GO. Your son is what is important not this guy who is an alcoholic obviously. Prioritize lady before your son hates your guts. Let the loser be who he is. Don’t interfer with this losers decisions to carry on drinking. That is his business not yours. Sorry, but I had to say it how it is and that is ………..move on!

He can be held in Contempt of Court and once he goes to court and then probation involved, he will be in violation of the court ordered probation, either one he can be put in jail for.And no it DOES NOT matter what town he is in! Most court systems does not allow you to move unless you also transfer your probation. Also he can be made attend AA Meetings, and closely monitored by the court system… However you must first PROVE to the courts that he is still drinking!

If he gets picked up for anything, his probation, parole, or conditional discharge will show up. If he’s drunk at the time (or even has just been drinking) he’ll likely be violated and turned over to the jurisdiction that imposed the restriction. At the very least, they would be notified assuming that the system is working as it should. Not always the case but you can always hope.

Have you tried calling the Victims of Violent Crime Hotline or Victims of Domestic Violence? What about Child Protective Services. You need Restraining Orders to protect your Son & Yourself. Concentrate on your immediate family & let time take care of your ex. The alcohol will render him weak in time, but until then, you really need protection from him so that if he comes around you can have him arrested. Let him drink himself to death & stop trying to control the uncontrolable!
