My 18 year old son was recently arrested with his buddies in public for under the influence of alcohol. While at the police station they also drew blood for a blood test. What are they looking for and what will the fine most likely be?

They are looking for the blood alcohol level. The amount of trouble they get in varies in each state. It is usually strictly not tolerated.

Since he wasn’t driving, not a whole lot (ticket and at most community service.)
They drew blood to see if he was under the influence of drugs as well, and if that comes back positive then he could have anywhere from 10 days to 90 days depending on the amount and quantity of the drug(s)

I live in California. I was arrested for the same thing, it was a slap on the wrist however they didnt draw my blood. Did he refuse a test? He will most likey get community service- worst case senario.

All my buddies got was getting locked up in the drunk tank until they sobered up. but they never got a blood test, just ask the police i’m sure it won’t be a big fine if any at all.

They are finding out his blood alcohol level so in court they can present it to the judge. He will probably end up in jail, and some fines too. Public intoxication, drinking underage, if there were minors around he might get hit for that too. I could see a month or two in jail maybe, or community service depending on how he acted to the officers and his record. Does he have any other misdeamors, unpaid parking tickets etc?? Does he have a job, go to school? They’ll look at all that. Get a good lawyer.

It is not illegal for anybody to simply be under the influence of alcohol. PC 647(f) requires that a person be so drunk that they are blocking the sidewalk or unable to care for their safety or the safety of others. That is pretty drunk. However, it is illegal to be under the influence of some drugs (Health & Saf. Code 11550) and the police may be looking for evidence of that. However, they may just be looking for evidence to bolster the accusation that he was really very drunk.
If a charge is filed (and an arrest does not necessarily mean a charge), a violation of PC 647(f) is not a very serious offense for somebody with no record, usually involving probation and a small fine or community service. However, upon conviction of a person under 21 for violating 647(f), the court is supposed to suspend his driver’s license for a year (VC 13202.5), so it is a conviction to be avoided, if possible. Because of this risk, you are far better off with counsel. If your son is unable to afford counsel, one will be appointed for him. If he is able to afford counsel, he should wait to be sure that a charge has been filed, and then request a continuance to retain counsel.
