Non-smoker needs help with smoking neighbors.?

I asked this question a couple of days ago but it has been deleted. I live in a building that has 2 apartments in it. I live on the bottom floor and have been here for 3 years. A couple has moved upstairs about 10 months ago and they smoke. I have no problem that they smoke in their own house but the smoke comes in my house. I really dont like smelling cigarettes at 5:30 in the morning and all day long. I am more concerned about my 2 young boys smelling the second hand smoke. The other morning my son was getting ready for school and started to cry. I asked him what was wrong, he said mommy I smell smoke and I dont like it. My heart dropped. I have put spray foam in all of the cracks. I also have spray and candles that I use but I dont want my kids to inhale that also, and besides that don’t work either. I have talked to my landlord and she don’t know what to do. I really dont want to move this apartment is very nice and affordable for me. WHAT CAN I DO?
What is wrong with some of you people I ask a question and get called CRAZY. If I’m so crazy then HOW DID I PASS A SYC. TEST TO BE A CORRECTION OFFICER. If your going to be smart about the question then don’t answer it. I DON’T CARE IF YOU DON’T BELIEVE ME I LIVE WITH THIS EVERY DAY YOU DON’T. I thought that I would get some answers that were going to help me, INSTEAD I get answers from smart —–.

You really don’t have much resolution for this other than moving, and it’s probably the best thing to prepare for. Until then, I suggest you cook a lot of fish and hope the smell seeps into their place!

Unless there is a clause in yours & their lease that this is a non smoking building, you have no other choice but to put up & shut up or move.
Renting an apartment is certainly cheaper than renting a house, but part of the savings means you have to tolerate others and their chosen lifestyle.
Just to warn you, if you were in one of my buildings and came to me constantly complaining about such petty things like this, I’d be finding an excuse to terminate your lease forcing you to move

I understand what you are going through. I have been forced to move twice because of smoking neighbors. Most recently, while I was nine-months pregnant with our first child.

Look at your state statutes. We are in Oklahoma, and under the state’s Landlord Tenant Act, landlords have 30-days to fix the problem (if it is related to uninhabitable/health issues) or tenants are legally released from their lease–free to move without any penalties.

We tried to fix the situation with different air filters, vent filters, caulking every hole and joint possible, and still nothing worked. We even had an environmental engineer come out to test the air and see if there was a solution. According to his report, not even the strongest, commercial-grade system (used to clean jet-fuel fumes at airports) would work.

We tried talking with our neighbor, and while he said he was sorry, he then seemed to smoke more.

The last straw was when we were forced from our apartment at 3 AM one morning because we couldn’t breath! My husband, me and my hugely pregnant belly went to a 24-hour cafe until morning.

You should not have to live in your situation, but unfortunately your remedy my depend on the state you live. There has been some favorable litigation in this area, but still not enough to protect everyone. You might have luck if you live in a more progressive state.

If you can, I would urge you to contact an attorney. If you were there before the other tenants, you may be able to have them move out instead of you. Unfortunately the condo below us was owner occupied, and we were just renters, so we didn’t have that option.

Thanks for doing what you do. Tough job.

There isn’t alot you can do if the landlord allows smokers. But if they don’t allow smokers, talk to your landlord about the smoking.

An air purifier is a great idea. I have an ionic breeze and it has made a big difference in my house.
