My wife has filed for nullity of our marriage and full custody of our son but they live with a 5 time felon?

Her father is a career criminal that has been in and out of prison for the past 35 years. His offenses range from making meth to counterfeiting. Also a long history of making fake checks.

My wife seams to think that is it okay to have my son around him and I don’t. My wife has a serious gambling habit and has been “86″ from most of the casinos in our area. One casino sent a certified letter to us telling her she is not welcome on the property. I also had my bank call me and tell me that she was trying to cash a check she forged from my bank account.

My wife was supposed to take our son back yesterday but she never showed up and still hasn’t called (about 17 hours late so far). She is pro-per and I am trying to hire an attorney but haven’t yet because when she left she took every penny with her and left us dead broke..

There are many more disturbing facts but the ones I listed above should be enough to get custody I would think.

So my question is…can anyone give me advise on the best way to present my case and get custody of my son.

Present it from the point of view of subjecting your child to being around such dishonesty and illegal behavior. You are afraid that some of it might be rubbed off on your son.

Make sure you gather all the proof you need before going to court, in this situation it shouldn’t be hard to find her unfit as a full custody parent. Not only is the illegal and unethical stuff bad but you can’t trust her to keep enough money around to feed and care for the child.

wow, dude i would go see a lawyer cause there would be no way for my wife to leave me and take my son to be around that kind of environment, its not healty for your son to be around that, cause if you dont do anything he’s is gonna pick up them bad habbits and you know follows, good luck

Look in the phone book for legal assistance and get yourself an attorney right away. Then file for an immediate emergency Order of Protection (or some kind of legal restraining order) on the grounds that she did not return to pick up your child. Then do your best to sue for full custody. You will have to go on a fact gathering mission, so make sure to document all those phone calls and letters.

Petition the court for custody (you should have an attorney but you do not need one to file) apply for legal aid in your area, ask the court clerk if there are paralegals in your area that can help you.

Document your evidence, including his past criminal history, and her willingness to present the children to that situation. Detail everything that would otherwise be detrimental to your children.

Tell them exactly what you’ve just said here. She doesn’t show up when she wants to see her son, she has a criminal history herself and she takes your child around another well know criminal. Although her crimes don’t necessarily put your son in physical danger, it should be enough to get you primary custody. If you can’t afford an attorney, at least have a consultation with one. You can sometimes get one for free or around $100.

You will first NEED the lawyer. this case is FAR too complicated to handel by yourself. Don;t even try! it would be a real shame to lose the case (and your son) because YOU didn’t understand all the little procedures and protocols of the court system. ONE LITTLE SLIP, and you lose on a technicality.

ONLY A LAWYER can advise you in these things. if her father has done his time, then he is considered a Free Man. it may not be possible to take HIS criminal record into court.

However, these letters from the casinos, sent to you, are probably good evidence.

Still YOU NEED A LAWYER. FIND the money somewhere, borrow it from friends, take out a loan. But GET THAT LAWYER.

By the way, since there is a child involved she cannot NULLIFY the marriage, she can only file for divorce.
