My ex took out a restraining on me but she is the one who was abusive? What should I do to contest it?

My girlfriend of 6 years recently served me with restraining order papers a week after we were last together. We had an arguement which resulted in me leaving her. She still had several of my belongings at her home which I tried to obtain but she wouldn’t give them back even after having a police go there. She has been extremely abusive and controlling throughout the relationship and I really feel that this is another one of her evil tactics. We were living together for the last 3 months and my things along with my son’s official documents are still there and I was asking for them back. Because of this she has put out a restraining order for me. The restraining order is full of lies but it looks as if I have been the one who has been abusive. I am so hurt because she was being so so nice prior to our argument and I really thought she cared but I guess not.She is an alcoholic as well. Does anyone know how I can get her to either drop the order or get the judge to dismiss it?

Ask your attorney what to do.

If you do not have an attorney, contact the referral service of the state bar association or your county bar association.

She has representation. If you do not, she has the advantage.

You can ask a Judge to direct the return of your belongings.
(Not much hope, if she’s as bad as you say,
she’s probably trashed them.)
Don’t even try to fight the order, it’s not worth the trouble
unless you can prove she lied, and you can’t.

When you were served with the order, there might have been information with it concerning the means of opposing the order. Usually, an order is only good for a short while and then the court must have a hearin and you must get notice of the hearing. Show up at the hearing and oppose it. Tell the judge that you just want to get your stuff and the judge will probably help make arrangements.

First, if there is not a record of reported violence, the courts know that many people file who are actually the perp and not the victim, so don’t sweat it…. but what you can do, is take her to court (small claims court is the easiest). Then you can explain her motive and what you need/want from her. If you would rather not go to court, many personal things can be replaced such a birth cert. etc… so it depends on what it less hassle to you.
IF she is that much of a nut case… I hope YOU have custody of the child. If not, then fight for it!
