He went to court where they recommended alcohol assessment. He was assessed and scheduled to begin a level 1 addictions treatment program. In the meantime his drivers lic. was suspended. Since this was around the holidays my husband and I were unable to take time off work to get him to the once weekly sessions 30 miles from our home. The judge indicated at his first appearance that he needed to complete this or would be issued a warrant for arrest. His court date is two wks away and he is scrambling to get into a program. Is it possible he will serve jail time for this? and if so how much can they give him? Thanks

no, just explain to the judge that the program is 30 miles and his lic. is suspended due to this unfortuneate problem and he has no way to get to and from the program. Maybe the judge can suggest a closer program that he can take a bus or cab to…b/c a 60 mile cab fare is expensive and buses probably don’t go that far.

They won’t put him in jail for a BS charge like minor consumption. The State just wants to make some money off him.

Your son is still considered a minor. Chances are, he is guilty of Probation Violation when he failed to attend his once weekly sessions. There is always a chance he will go to jail, but in these cases, the sentence is usually light, from two weeks to a month, and these young people are usually placed together in an area away from other prisoners. They are allowed visitors a couple of times a week and are allowed to use a commissary for snack food and necessities. They are allowed to call home, but the Collect calls are expensive. Then, too, they often have an Early Release program. You will also pay a fine and court costs.
Drinking and drug use are a problem with young people of today, with drugs like heroin providing a cheap….and very dangerous..thrill, and alcohol providing a sense of forbidden pleasure. The best thing to remember is that they DO grow up, and someday all of this will be just a faded memory.
On the plus side, these minor offenses are not usually kept as a part of a permanent record. Your son will be able to complete his program without having this mistake follow him around as he goes on with his life.

His level 1 is the lowest evaluation you can receive with an ASAP evaluation.
His license is suspended – under the Graduated Drivers License Program. He will not go to jail, he will likely get supervision and a fine.
