In regards to custody, how do you prove that your ex is an alcoholic/drug user?

I have a paternity suit pending against my ex fiance. Our child is 4 months old and he has never seen the child, called, asked for pictures, or anything. He abandoned me when I was 14 weeks pregnant and I haven’t heard from him since (well once when he was really drunk and threatening me). He is an alcoholic. He has a DUI on his record. He drinks 1-2 CASES of beer per night plus whatever whiskey he can get. Everyone knows he is an alcoholic. I don’t want him around my son until he is sober. But how do you prove in court that a person is an alcoholic? He lives three states away.
I asked my attorney and he just blew me off.
john, it’s obvious to me that you don’t understand parenthood or not. Visitation and child support are two separate entities in the eyes of the legal system. why are you answering this question when you obviously don’t know **** about legality?

You have an attorney in this paternity suit. Consult your attorney on what you may have to prove to the court and how that may be accomplished.

If your ex is an alcoholic, has no interest in your child, and lives three states away, I don’t think your going to have much of a problem any time soon keeping him away from your son.

the fact that he has a DUI could help you prove he is an alcoholic.but the human mind can hide many things such as past drug use. some people you can really tell and some you cannot. so the drug part is out of the question unless he has obvious problems that are directly drug use related or if you can get him to take a urinaryanalysis,or hair folicle test.although his dependence on alchol sounds pretty extreme 1-2 cases a night? dang. i guess you could try to recomend him to treatment and try to get his life back together since it sounds like he cant himself. hope it works out for you i have had friends in high school that had the same problem and so did i at one time but with drugs. good luck

Funny you say you don’t want him around your son, but you also begin with admitting you have a paternity suit against him- which presumably means you are suing him for child support as well.
Now while I believe no child needs to have drunks around him, you might look at the rather contradictory nature of your desires, as if he’s paying child support he’s going to be due some custody and time with the child. It isn’t fair to look at him as only a paycheck, drunk or not.

BTW your attorney likely doesn’t want to raise the issue because it’s not relevant to the paternity suit and may even undermine your ability to collect support-when he argues before a judge that the man needs to support the child his argument will include that the father needs to become involved with raising this child- including financially, but also physically.
