if my ex gives up all rights to our son does he still have to pay child support?

he wont give up his rights unless child support is stopped which is okay with me the only problem is i get medicaid for my child. i was told that if child support is stopped the state will stop my medical coverage for my son; is this true. my son does not want to see his father because os alcohol/drug and domestic abuse issues.
to the person who called me a low life i would like you to know that i am a nurse and do work and probably make more than you. and the reason my son is on medicaid along with other ins. is because of his midecal problems so don’t be too quick to judge.

I don’t think he will have to pay child support, but you should check with your caseworker about the medicaid. Don’t take anybody else’s word on that.

You need to go back and file for full custody and let the court decide if your ex is entitled to visitation. If you have documentation of drug abuse and physical abuse, the judge will not allow visitation. You should not allow his bad behavior to let him opt out of his financial responsibilities to his son.

What your ex is trying to do is called EXTORTION and it is a crime. Even if your useless ex gives up all his rights to your son, he still has a responsibility towards your son and child support shouldn’t be ceased. What i suggest you do, is get your ex to give up his rights in exchange for your stopping his child support claim, but as soon as he has given up his rights in writing, then file for child support again. Shouldn’t be a problem. He is the father of your son, he has a responsibility towards your son. I can understand you trying to shield your son from this irresponsible and useless undeserving father, but I say he must still pay for his son and you shudn’t have to crack ur head of his shit.

Do not allow your husband to threaten you. Take him back to court and try to get his visitation rights revoked. He obviously doesn’t want to see his son anyway. Even if he does not have visitation rights, he will still be required to make child support payments.
