I want to change my son’s last name ….?

right now his last name is hyphenated with both his dad’s last name and my last name and it sounds ridiculous (his dad’s last name sounds horrible… and its even worse when added onto my last name)… that is not the only reason why i want it changed though… his dad is a drug addict and wouldn’t stop doing cocaine after our son was born and was almost never around cause doing drugs and staying out all night was more important to him than being a good dad…. and then he was arrested and went to prison for a year. now that he is out he sends me money every once in a while… but not often and not very much at all. also, i tell him he can see his son whenever he wants… and he doesnt live that far away… but for some reason he can only manage to see him 1 or 2 sundays a month. my son barely even knows him. i dont think he would give consent to change our sons last name to only my last name… but i think i might be able to anyway? how do i do it?
we were never married…. but he did sign paternity papers when he was born…. and to that chick that said my son might think i dont like him if i change his last name… your a f***** idiot! i think i give my son plenty of love and attention for him to know that i love him no matter wahat… F*** you.

For better or worse, your son is his father’s child and we take part of our identity, for good or ill, from our parents. Fo your son’s sake, I hope that you consider changing his name as something very serious. Even though your son doesn’t know his father very well, and his father is a poor excuse for one, and your son might be very young, eventually it might have repercussions for your son. Because sometimes kids think that if you don’t like the other parent, then you must not like the part of them that came from that parent.

If you are truly want to change your son’s name, however, you will need to consult an attorney.

Edited to add: I never stated that you didn’t love your son or that your son wouldn’t think you loved him. You need to go back and read my reply to you.

He either has to give consent, OR he has to at least be notified, sometimes a legal notice in the paper is all thats required, and given an opportunity to oppose it.

Talk to a lawyer, they can tell you about the entire process, and the fees. Without consent, it is usually more expensive.

Were you married? Then he has to sign papers to let you. If not, you have to terminate his parental rights. Then put it in the news paper. You have to run a ad about it. Well this is what they do in NV. I had to change my lil girls last name.

This has to go through the court system. To keep it out of the court system, the father will have to sign consent first where he is on the birth certificate.

Even with his name off of the birth certificate, he is still his father. You will not be able to just change his birth certificate without the fathers consent. Same thing happened to me. My sons middle name was spelled wrong so I had to go find his father to get changed correctly.

1. go up to the courts — courthouse – whatever you have, and ask where you can get a form for a name change. on the form- it will tell you what you need to do.
2. it will tell you to send notification of the name change to the dad………he will have a certain amount of time – after receiving the document to say he doesn’t want this done
3.. when I did it – I had to go to court- but, that could be because the dad didn’t want it changed….
it was easy to do- was less then $100 i think.
