On the 12th I got a restraining order against my ex (which is my son’s bio father). I had to write an affidavit telling the judge he was a drug abuser, he was abusive towards me, he was an alcoholic, and he has tried to commit suicide numerous times. I forgot to put in he even had put welts on my son and that my son has a scar on his bottom lip from him!!! Now, I was wondering, he can try to fight the RO on the 23rd. If he is like “I wanna see my son”, will the judge let him? If I have any say, Im just gonna tell the judge I want him to file for it and stuff. But, my question is How can I tell the judge about the abuse towards my son and will the judge let him see him??
I got the restraining order in the 1st place because he threatened me over the phone by saying “Ill beat the fuck out of you & take Stephen & no one will see him!”
Also, the restraining order IS for me and my son. It protects us both. Plus, my ex hasnt seen my son for over a year. Last date was July 2nd 2006. Last time he did cocaine that I know about was January 4th or 5th.

Sounds like a bunch of drama.
Unfortunately, your child’s father still has rights to visitation regardless of what goes on between you and him. You can mention these things to the judge but unless they are documented (police reports, etc.), the judge probably won’t take them into consideration. If it ever happens again, call the police immediately and take pictures!

The first thing you need to do is get a Family Law attorney if you don’t already have one.
The other thing you need to start doing is documenting any and all instances of abuse (towards you or your son), complete with descriptions of behavior, injuries, dates, and times.
As it stands right now, because you didn’t include the information in the original affidavit, a judge may very well award him visitation. Courts are very hesitant to remove children from a parents presence completely unless there is indisputable proof that the parent is a danger to the child’s physical or emotional well-being (and sometimes they’ll still award visitation even when the evidence is staring them in the face).
The fact that you have a restraining order against him for your own person does not automatically mean he doesn’t get visitation. My soon-to-be-ex still gets visitation with our children even though I have a restraining order against him for domestic violence while our children were present (though asleep).
You do need to get all this on the official record ASAP. A lawyer will be able to aide you in doing this as quickly and efficiently as possible.

at the best he probably can get supervised visits, but this assumes everything you claim you can prove to a court of law about your ex, just your say so probably will not be enough hard evidence shall be needed
on the hearing on the 23 all this judge should decided if their is enough evidence of immediate danger to you that the temporary order should become permanent or vacated the judge should listen to all you have to say at that time about the danger your ex is toward you and your child
, they should not at that time discuss a custody issue

It would be helpful if you have some tapes of this man going off. I think that the judge may give visits that are under supervision of the family services. You should have asked for the restraining order to protect the baby.

thats a hard situation you have there, and your right, you need to protect your child, or at least try to.
they usually allow visitation to fathers, even if they are crackheads or murderers. burden of proof is on you that he is a very real threat to your childs life or wellbeing.
sad but true.
maybe request some sort of mental evaluation on him, supervised visitation,etc.
