First of all she will need money to do this. She gave up her rights and as long as she hangs out with the same people-that is all you need to say if it does go to court. She will never be able to afford it-she loves drugs to much!

It is all about what is best for your son. She can take you to court which will be expensive if you fight. If you have documented proof that she has not turned her life around, the odds of her actually getting custody are not good. When and if she does turn into the perfect mother material she has a better chance. Just make sure you are the better parent!

If she has visitation, she didn’t give up her rights, merely chose to not have custody. And to answer your question, and from my 20 years of working with fathers, I would sat:

I’ve seen it happen. In one case, a drug addicted mother didn’t know the 4 year old was out wandering the streets of downtown Dallas. The father only found out about it because expecting it to happen, and not getting any help from the courts, sent out precautionary fliers to all the ER Rooms in the region. Two years later the courts gave her back the child after she proved to them she was clean. Two years later the child was dead.

Keep a daily journal on your daily life with the child and your knowledge about the mother. Don’t expound or exaggerate. Clip the lead story title from the newspaper each day and paste it on each day’s page. This is your number one piece of evidence in court, and you can read from it on the stand.
