How do I go about getting my fiancée to adopt my son?

My sons biological dad is not in the picture my son doesn’t know him. He has been in and out of jail and the nut house for domestic abuse (me and his new gay lover) he is addicted to meth and apparently is gay now (probably from being in jail so much. So obviously you can see why I want him to have no contact with my son (not that he’s tried to see Logan for the past 5 hrs) he pays no child support but That doesn’t bother me. Logan calls Steve,my fiancée, daddy Steve has been the one supporting Logan for the last 4 years we have been together. Steve IS logan’s dad as far as we are all concerned. But unfortunatly, Logan still has his bio-dad’s last name. Steve wants to legally adopt Logan as does Steve’s and my family. I just don’t know how to go about doing it. Can’t afford to get married just yet. My question is this: how do we go about Steve legally adopting Logan do we absolutely have to be married first? Or are there certain loopholes? Please helpi need some good advise. Has anyone experiance similar to this? Again please help us

My situation was really close to yours so what i did was legally change my sons last name. It was really cheap in court and really easy. You can do it yourself just go to the court and buy the packet. I did that two years ago. I am now married and my husband is doing a step parent adoption which is super easy and in CA it only cost 700 dollars.

Your son’s father would have to sign off on an adoption. Whether he’s a nice guy or not (hey, YOU’RE the one who decided to have a baby with him!), that’s the law. If your fiance (“fiancee” is for a woman) wants to adopt your child, he has to marry you first and the child’s father has to relinquish his rights.

Whether the father is in the child’s life right now or not, Steve is NOT your child’s father. If he marries you, you can make him the daddy on paper, but it’ll never change your son’s DNA. He has a right to know where he came from and who both his biological parents are.

Here’s something else for you to think about: what if Steve turns out not to be the man of your dreams but has already adopted YOUR son. Then what? You realize he gets half the rights to YOUR kid, right? I’d think about this a whole lot more if I were you.
