How do I get my son’s father’s parental rights severed?

My son is almost 8 years old. His father has not seen him in almost 3 years. He has not attempted to contact him or my family. While his father and i were together we (my son and i) were physically and emotionally abused. His father is alcohol and drug addicted. At one point we had a restraining order against him. He has never in my sons life paid for done anything to benefit him. My son is now happily being taken care of by my fiance and i. Would I have to face my son’s father in court? What steps would i have to take to get his rights taken away? If we do have to go to court, would he be able to find out where I live now?

Go to court and have the visitation rights changed to “supervised only”.
That is about the same thing because the ex would have to meet your son either at the police station or courthouse in a conference room, with a cop or other court officer in the room.
You can see that since the ex isn’t participating now, he will be even less disposed towards keeping in contact with his son.

Go talk to a lawyer. Seriously, laws differ greatly state to state and it depends on what state you are in, what state he is in…. Many offer free initial consultations. My sister-in-law went through this. She never had to see her ex and neither did her child. Seeing a lawyer helped her avoid a big mess and extra expense.

Go to a lawyer because there are steps that you will have to go through. It made be an expense now for you but down the road you have done everything you right. Most likely you will have to go to court to change his custodial rights. A lawyer can advise you about forms, and the restraining order issues.

you will have to have him sign off on these rights & no they won’t be able to give out your address. Usually all he’ll have to do if he agrees with it is just sign it in front of a notary & your attorney would present it in court.
