My brother wants to get full custody of his son. His son’s mom has a terrible background she cheated on my brother, then married the guy then cheated on her husband, and is living with an “alleged” Meth dealer that has beaten her up and has threatened my nephew. He has been in 4 different homes since she divorced her husband only like 4 months ago She also has past drug problems (we think she is using again obviously) he has a few people that will testify in his favor and this includes her ex husband and the father of one of her other sons (she has given up custody of her two oldest boys) He has tried to talk to her about taking his son for the summer and she accused him of trying to take him away from her. I know its hard for dad’s to get custody and he doesn’t really have the money to get a good lawyer. Is it possible for him to do it on his own? is their any organizations out there that help dads in these types of situations?

i was a single father….i won custody over my daughter twice…my ex lost first time came back a yr later and she lost again…my ex liked her parties and i didnt drink….so
he’s the father…he’d have a good chance for winning his son….providing he’s clean and can provide for him…any parent has a good chance for getting custody if they can provide for there kids…

If all of his documentations are in order..with proof of her ongoing behaviors..he could end up with full custody and she with visitations..he would be wise to request supervised visitations.. a risk assesstment and drug testing.. due to drug use. He could do this pro se..the courts would help him fill up the paper work, he serves the mother by mailings..the court will explain all of that to him. the fees are must less than a lawyer.

He has a very good chance! There are numerous organizations available to assist single dads……just google, “single father help organization” and you’ll come up with several. My brother was 22 yrs. old, and attempting to get custody away from his 25 yr old former girlfriend. They had lived together, but were never married. She wasn’t a drug user or alcoholic, she was employed and she wasn’t abusing the child physically. However, she was moving around all the time just like the mom in your post…..5 homes in less than a year all with various roomates–some of whom she allegedly met online. She referred to my brother as “the sperm donor” and refused to allow him to help in making decisions about their daughters education, medical needs, etc. Every time she moved, it was further away. Her only issue that I would call endangerment was that she practiced a very strict, vegan diet and she forced the little girl (age 2) to follow the same diet–very unhealthy for a child that young. They NEED fat and cholesterol in their diets for proper brain development. My brother also did not have a lot of money.He found a good lawyer thru a referal from a friend and he sold his house to obtain the money to pay. The end result was that he won sole custody and she was awarded visitation and was ordered to pay him child support. He ended up spending about $15,000.00 total for lawyers, guardian ad litum, psych eval for the child, court costs, etc. If your brother has some way–any way–of coming up with even the retainer for the attorney, most will arrange a payment plan for the rest. I wish your brother the best of luck and hope it works out!
