my nephew is living with me, his mother (my sister) is a drug addict. I do not have legal custody of him yet. He is on diability, thru social security. He is 13 yrs. old. My sister refuses to give me his money for his care. what can I do? It seems like everyone takes up for her. Her probation officer even told me that she should only give me 300.00 of his money, because she needs to live too. Isn’t that money for HIM and his Care? Please someone help me…

I don’t know much about social security for kids, but what I DO know is that the money is for the child, not for the parent, ESPECIALLY since he is not living with his mother! you need to work on getting legal custody of him, that may make all the difference in the world. If you know his social security number, I would contact social security to let them know that he is living with you and not with the mother. They may request the custody agreement so they can start sending the check to you.

With out legal custody you can do nothing. You need to get a lawyer and get legal custody before you can do anything else. Once you are awarded custody you can have the checks put in your name 9as his guardian) and set directly to you—the SS office can do this without sister consent or knowledge as long as you can prove he is living with you AND you are the legal guardian.

The mother has legal custody and the money is sent to her to take care of son. Do contact social security and let them know that he no longer lives with her they will stop and investigate. She has a legal obligation to the son and if he’s no longer there she could be held liable and have to repay the checks he has not recieved.

You need to go to Social Services and apply for AFDC and tell them the child lives in your home. Also tell them that the mother is getting SSI for the child, they will either turn her in for you or they will go after her for child support. Her days of spending that poor kids money on drugs are over. But be prepared when she finds out her meal ticket has run out she might want the kid back. So make sure its worth it.
