Does an employer have to test everyone, for random drug tests, or can he pick and choose?

I work at a family run store. The owner recently said that we’re going to start taking random drug tests. I don’t do anything, so I’m not worried.
However, his son is a huge meth head and a manager there. Can he legally only test non-family members or does he have to test all employees of the company? I work in Indiana by the way.

I think they can randomly test at any time. I had a job where everyone got one but me from what I know. I am drug free but still….it was just weird.

He might be doing this specifically for a reason to get rid of his son. Also, if he likes his son, no I’m sure he doesn’t have to test him.

Unless you work for a federal lab or something like that legally it is bull crap. Some company paid some heavy weight lobbyist to invade our privacy.

My company runs random drug test on the job sites and that is there policy. They asked me to create a random number chart since I am in IT and I asked for the employee numbers. Used those numbers on a program and generated random ones which was used for the tests. If you are getting rid of someone and the questions rises in court how it was generated you have to give proper reasons, it might be also draw out of a hat.

Maybe that’s why he wants to start doing the drug-testing. He’s probably more aware of his son’s drug problems than he’s led you to believe, I seriously doubt that he would discuss that with one of his employees anyway. Maybe he’s hoping his tweaker kid will just quit so he doesn’t have to have a big dramatic confrontation.

Fortunately for YOU, this is not your problem so just go with the flow.

It sounds to me like your employer has a long-range plan, and you might not see the results right away but I think that that some changes are afoot…………
