Do cops need a search warrant if they smell a meth lab?

Cops came to my ex-son-in-law’s house to serve a ‘protective order’ and said they smelled chemicals so they busted in and found a meth lab. He was arrested and now says his lawyer told him he will probably get off because there was no search warrant. I HOPE NOT, but is this true? It happened in Tulsa.

No, a warrant is not needed if the officers have probable cause plus exigent cirucumstance.

Exigent circumstance is something that makes getting a warrant impractical, such as a danger to the public, the threat of destruction of evidence, or escape of the suspect. Any of those may apply in this case.

No it’s not true. They had probable cause. It’s like if you get pulled over and a cop smells marijuana in the car, they have probable cause to search the car. I’m glad to hear he’s your ex son in law, I would hate to have someone who is running a meth lab in the family. Don’t worry though, his lawyer was wrong on that.

Yes, they can’t break into private property without a search warrant.
