I legally gave my son my house. Me and my husband still live there. I am divorcing my husband because me and my son are recovering addicts and my husband refuses to stop bringing and drinking alcohol in the house. The house has been in my son’s name for 3 years. We can’t live in that environment and keep our sobriety. Can my son legally have my husband removed from his house?

Yes he can. Tell your husband that he has 30 days to get out.

Yes, but he needs to consult a real estate attorney and follow the correct procedure for legal eviction. Which includes serving him and going to court.

First of all congrats on recovering and good luck with your new life. Yes you can have him removed but you have to legally evict him

That depends on the state laws that you live in. You could have him removed with an emergency 5 day or you can get a thirty day removal.Look on the net that should help you out to at least know what your state laws are.Or if he has issues with illegal substance abuse you have him arrested if he had it on his person. I know that sounds harsh but if it was my sobriety or him jeopardizing it then I’d sure pick having him locked up. Congratulations on you and you sons sobriety. Good luck to you three.
