I don’t know that you can sue them, but the state can revoke their liquor license, and potentially bring criminal charges against the people who sold it and/or the owners of the store.

I am sure you can, but you have to be able to proof that they sold it to him. If you can’t sue, I am sure you can get them in serious trouble.
If there were any problems caused by it and you can prove that they store sold the alcohol to him and not to someone who then gave it to him. It dosen’t matter what state you are in, failure to ID a minor and selling them alcohol is illegal! I’d speak with your local police.
If they were in violation of state law. If your son used a resonably good fake I.D. then there’s nothing you can do.

Call a lawyer to find out for sure. They handle these kinds of cases for a percentage (usually 33%) of whatever the court awards in damages. As a result, you don’t have to pay out of pocket expenses so you don’ thave anything to lose in calling a lawyer.
Well, anybody can sue anyone. The real question is whether you can prevail in a lawsuit. Unless there was some type of lasting damages then I doubt that you could prevail, even with a jury. Sure, its something they shouldn’t have done, but unless you can prove that it damaged your son in some way then you aren’t likely to win a suit.
If your goal is to punish the store, then turn them into the Alcohol Control Board (or whatever its called in California). They will discipline the store owners and the employee(s) that sold it. You do have to be able to prove that the store sold it to him.

If you have proof that they sold him the alcohol the store can lose their alcohol license and the person that sold it can be charged a $1500 dollar fine.
First you need to report this to the local Police Department, and let them handle it. If your son has already sobered up, it will be difficult, but not impossible to prove. Most store have surveillance tapes that will be reviewed by the Detective that is assigned to your case. Report it NOW, before it is too late. CA has very strict laws on this issue. The store clerk will be arrested in most cases. You then use the Police Reports and Court Documents to pursue your case against the store and it’s owners for negligence and endangering the life of a minor, depending on the circumstances involved. You really need to seek legal council on the latter advice.
yes, it is illegal to enter into a contract with a minor. he gets his money back. now, lets assume your son caused thousands of dollars in property damage. you need a good lawyer because the parent is liable for punitive damages caused by the child and it is easier to sue the parent than the liquor store. you would then need to sue the liquor store if you lost so you would at least need to consult with a good attorney or me to discuss the exact details
