My 16 year old son left school campus for lunch. During that time he took a shot of Jack Daniels with a friend and then returned to school. While talking with a teacher, she smelled the alcohol. The school priciple was notified who in turn called the police to breathalyse my son. To sum it up, my son now is facing an expulsion. What are his rights?

Very little. The school principle holds a power called In Loco Parentis, which means he can act in place of the parent. To me, that is a grievous conflict of interest, as well as a capricious failure to act in the best interests of a minor. But that’s the way it is. As parents, you should probably contact a lawyer about filing a suit against the school. And as a word of warning, 75% of all lawyers will give you the old “here’s how it usually works, the judge always rules for the school,” etc etc. Those kinds of lawyers whould be disbarred for impersonating a lawyer. FInd one who will actually represent you instead of sell you out for a fee.

First, being a minor with any detectable amount of alcohol is a problem. Even bigger question, was your son driving a vehicle? Because he might be in for a DUI if he drove back after taking a shot. Second, minors at school do not have many privacy rights. The breath test is a search and the school has a right to conduct a search on any student as long as it is not done discriminatorily. Also, it is unlikely they held his head to the PBT or Intoxilzyer so if he blew, he consented.
At this point, a lawyer may be able to help mitigate the punishment by negotiating with them, but it is still unlikely. The school was well within their rights and your son was legally wrong in his actions.

The school didnt breathalyze your son..they cant..what they did do is smeel alcohol and do what they are required by law to do and notify law enforcement,who then gave your son a PBT,Which he failed ,which failing is a criminal offense and grounds for expulsion,the school did nothing wrong ,and did exactly what they are supposed to do,for the best interest and to protect, the children. You should be mad at your kid for what he did ,but instead are mad at the school because he got caught,so your one of those parents enabling your kid to drink and such,your part of his problem, instead of making him face the consequences of his actions you want to be mad a the school or someone,anyone but your kid ,who is the one who did something wrong..parents like you are whats wrong with kids nowdays and why they dont accept responsibility for anything.

He really doesn’t have very many rights. The teacher smelled the alcohol, so the police had more than enough “probable cause” to run a breathalyser test. What makes you think they need your permission?
