My husband and I are trying to get full custody of his son. The mother is on drugs, was arrested last year for pos. of meth, and then indicted this year. We have pictures that show where she put bruises all over my step-son’s legs for spilling something on a new rug. Her and her mom have taught Dalland, my step-son, to act like a girl. He hardly plays with boy toys, he is attracted to girl things. He is better some, but he gets picked on at school. We just don’t know what to do. We have a lawyer, but we don’t have the money to go to court. Is there anyway around the money issue?

my husb and i won custody of his daughter in august.his attorerney was really good about letting him make payments after he paid the initial retainer fee,good luck

I won custody of my two children in 04′. The courts are slow to overturn custody rulings unless there has been an extreme change in circumstances, or endangerment to the child. If there is proof, then child or social services could be called in to verify this. But you must be careful, in the event the courts reopen the case you will be scrutinized also. The cost is usually very little to file the court papers yourself. But a good lawyer is invaluable if it goes any further. Good Luck!

Well, my first suggestion would be to tell you to file a motion with the friend of the court referee for a change of circumstances. According to the information you have provided, there has been a severe change of circumstances. I’m not sure what state you live in, but in Michigan you can go before the referee and they can make a determination on custody. You don’t have to go in with a lawyer, unless you decide to take that route. The only cost you will incur is the filing fee, nothing more. Usually the only time it goes before the judge is when you wish to appeal the referee’s recommendation. Then it gets quite costly. Just make sure you have all the information about the abuse and the drug possession with you, also have copies to give to the referee. Remember, the referee is only a lawyer appointed to hear cases, they’re not judges, but you have to show them the same respect as a judge.
