What do I need to do to adopt my ex-wife’s son. I have been his dad since he was 2. He is now 12. The mother is an alcoholic and have left the state. The “father” has never been in his life.Dont pay child Support. His aunt have temp.custody,but he lives with me full time. The aunt and the rest of the family wants me to adopt him. Both the mother and father have said in the past that they both will agree to me legally adopt him. Hard to raise a child when I have no legal rights. What do I need to do?
Just wanted to add that its not following the court order to let my kid live with me.The aunt is supposed to make a home for him. And pay for afters school care And isurance etc. But that has all been taken care of by me. Also the aunt had to file to extend the temp.custody for a reason that I am not sure about.The mother did not sign away her rights. She just didnt show up since she was in detox out of state yet again. And she is there now also.

Talk to a lawyer. They will tell you what steps you need to take to legally adopt the child.

Hire and attorney and proceed ahead. With the child being 12 and living with you for the majority of his life and I think that all goes in your favor. I don’t understand how his aunt could have temp custody and he not live with her—that wouldn’t be allowed here.

I agree you need to talk to a lawyer. It really should not be hard since every one seems to be cooperating. If both the parents and the current guardian are willing to let you adopt it should really just be a matter of paper work. Good luck and i hope every thing works out.

Adoption can be a lengthy process, especially since you have to attempt to locate both is mother and his biological father. Right now, you have no legal rights. The first thing is go to probate court. You can file for guardianship. This will give you legal custody and let the child stay with you, also give you the right to make educational/medical decisions. Once that is done you can progress with adoption and not worry about not having legal rights.

You will need an attorney for the adoption process but you can file for guardianship yourself. They will give you the paperwork and most probate courts have some kind of clinic to assist you if you have problems with the forms. It seems weird that it doesn’t go through family court, but they can’t issue guardianship for you, you’ll want to google your county/state and probate court and find out where to go.

Why not just file for guardianship instead? That way you don’t make your kid live the legalised lie that is adoption. Also, depending on where you are, your kid might lose access to his records.

Petition for legal guardianship rather than adoption – it’s a whole lot saner.

Get an attorney but think long and hard before you make the step. The father is apt to step up once all of the hard work is done and ruin the family that you have cherished for so many years. I am speaking from experience.
If you can get the mother to terminate her rights step parent adoptions really aren’t all that complicated. Did she terminate them when temp. custody was given to the aunt?
I hope you have a wonderful experience with the process. A child is a gift no matter how they enter your life.
